How do you Know if You Count as a Producer
Knowing whether you count as a producer is critical to understanding if you are subject to producer responsibility. Here, you will find guidance specific to your situation.
You are considered a producer if you manufacture or have electrical equipment and batteries manufactured under your own name. You are also considered a producer if you are the first to import electrical equipment and batteries into Sweden and make them available on the Swedish market. You also count as a producer if you sell electrical equipment remotely to users in other EU countries. The same applies to foreign companies selling electrical equipment directly to end users in Sweden.
However, if you are only a reseller or distributor in Sweden and do not import electrical equipment or batteries yourself, you are not considered a producer.
Foreign suppliers within the EU can assume producer responsibility from a Swedish importer, but they must have a legal representative in Sweden – referred to as an Authorised Representative (producentombud in Swedish).
